The Machinery Regulation (EU) 2023/1230

Machinery is the route where electronics teams most often underestimate the work. Risk assessment, functional safety and documentation are engineering deliverables in their own right, not paperwork produced at the end.

What it covers

Regulation (EU) 2023/1230 replaces the Machinery Directive and applies from January 2027. It covers machinery, related products and safety components, with essential health and safety requirements covering mechanical, electrical, control-system and, newly, cybersecurity and AI-related aspects of safety functions.

  • A documented risk assessment is mandatory and drives every design choice
  • Safety components and safety functions carry their own conformity route
  • High-risk categories in Annex I require notified body involvement
  • EMC still applies through the EMC Directive; radio through RED

Does it apply to you?

Machinery means an assembly with at least one moving part, driven by a power source other than direct human effort. Many products teams think of as an appliance qualify.

  • Motorised assemblies, actuators, robotic cells, automated lab and production equipment
  • Safety components placed on the market separately, such as emergency stop devices or safety controllers
  • Partly completed machinery, which needs a Declaration of Incorporation and assembly instructions instead of a Declaration of Conformity

What testing looks like

Machinery conformity is assessment-led. Type testing is only part of it; the technical file has to show that identified hazards were reduced by design and that residual risk is controlled and communicated.

  • Risk assessment to EN ISO 12100, iterated with the design
  • Functional safety of control systems to EN ISO 13849-1 with a required performance level per safety function, or IEC 62061
  • Electrical equipment of machines to EN 60204-1: protective bonding, stop categories, insulation resistance
  • EMC to the industrial levels of EN IEC 61000-6-2 and 6-4, with immunity criteria defined for safety functions
  • Instruction handbook in the language of every market where the machine is placed

Common failures

  • Risk assessment written after the design is frozen, so mitigations become guards and warnings instead of design changes
  • Safety functions implemented in general-purpose firmware with no architecture, diagnostic coverage or MTTFD justification
  • Stop category chosen without analysis, so the required performance level cannot be met
  • Immunity failures on safety inputs because industrial levels were never targeted
  • Missing or unsigned Declaration of Incorporation for partly completed machinery

Frequently asked questions

Do I follow the Machinery Directive or the Machinery Regulation?

Directive 2006/42/EC applies until 19 January 2027, after which Regulation (EU) 2023/1230 applies. Any product being designed now should target the Regulation.

Does the Machinery Regulation replace the EMC Directive?

No. Machinery covers safety; EMC conformity is still declared under the EMC Directive, and any radio under RED. A machine typically carries one Declaration of Conformity listing all of them.

What is partly completed machinery?

An assembly that cannot perform a specific application on its own and is intended for incorporation into other machinery. It ships with a Declaration of Incorporation and assembly instructions, and does not carry a CE mark for machinery.
